Victims of the Lou Pearlman investment scam are understandably anxious to claim a tax loss. There’s no question that you can claim a capital loss of the $3,000-a-year variety on your 2007 return. However, the requirements for a larger Section 165 fraud loss are much more stringent and I don’t think they have been met yet.
